I. PRIVACY POLICY AND DATA PROTECTION

In accordance with current legislation, Ignacio garcía – Call for Curators (hereinafter referred to as the Website) is committed to adopting the necessary technical and organizational measures, appropriate to the level of security relative to the risk of the data collected.

This privacy policy is adapted to the current Spanish and European regulations on personal data protection on the internet. Specifically, it complies with the following regulations:

Registration of Personal Data

In compliance with the GDPR and LOPD-GDD, we inform you that the personal data collected by Call for Curators through the forms on its pages will be included and processed in our file to facilitate, expedite, and fulfill the commitments established between Call for Curators and the User, or to maintain the relationship established in the forms that the User completes, or to respond to a request or query. Additionally, in accordance with the GDPR and LOPD-GDD, except for the exception provided in Article 30.5 of the GDPR, a record of processing activities specifying, according to their purposes, the processing activities carried out and other circumstances established in the GDPR is maintained.

Principles Applicable to the Processing of Personal Data

The processing of the User’s personal data will be subject to the following principles established in Article 5 of the GDPR and Articles 4 and following of Organic Law 3/2018 of 5 December on Personal Data Protection and guarantee of digital rights:

  • Principle of Purpose Limitation: Personal data will be collected for specified, explicit, and legitimate purposes.

  • Principle of Accuracy: Personal data must be accurate and kept up to date.
  • Principle of Storage Limitation: Personal data will only be retained in a form that permits the identification of the User for as long as necessary for the purposes of their processing.
  • Principle of Integrity and Confidentiality: Personal data will be processed in a manner that ensures their security and confidentiality.
  • Principle of Proactive Accountability: The Data Controller will be responsible for ensuring compliance with the above principles.

Categories of Personal Data

The categories of data processed at Call for Curators are solely identifying data. Under no circumstances are special categories of personal data processed as defined in Article 9 of the GDPR.

Legal Basis for Processing Personal Data

The legal basis for the processing of personal data is consent. Call for Curators undertakes to obtain the explicit and verifiable consent of the User for the processing of their personal data for one or more specific purposes. The User has the right to withdraw their consent at any time. It will be as easy to withdraw consent as it is to give it. As a general rule, the withdrawal of consent will not affect the use of the Website. When the User must or can provide their data through forms to make inquiries, request information, or for reasons related to the content of the Website, they will be informed if the completion of any of them is mandatory due to being essential for the proper development of the operation carried out.

Purposes of Processing Personal Data

Personal data is collected and managed by Call for Curators to facilitate, expedite, and fulfill the commitments established between the Website and the User or to maintain the relationship established in the forms the User completes or to respond to a request or query. If the Data Controller intends to transfer personal data to a third country or international organization, the User will be informed at the time the personal data is obtained about the third country or international organization to which the data is intended to be transferred, as well as the existence or absence of an adequacy decision by the Commission.

Transfers of Personal Data to Third Countries

The personal data we collect may be transferred to and processed in one or more countries outside the European Union (EU) or the European Economic Area (EEA), including the United States. When we transfer your data to these countries, we ensure that appropriate safeguards are in place, such as the standard contractual clauses approved by the European Commission, to ensure a similar degree of protection as afforded within the EU/EEA.

Personal Data of Minors

In accordance with Articles 8 of the GDPR and 7 of Organic Law 3/2018 of 5 December on Personal Data Protection and guarantee of digital rights, only those over 14 years of age can lawfully consent to the processing of their personal data by Call for Curators. If the minor is under 14 years of age, the consent of the parents or guardians will be required for the processing, and such consent will only be considered lawful to the extent that they have authorized it.

Confidentiality and Security of Personal Data

Call for Curators is committed to adopting the necessary technical and organizational measures, depending on the level of security appropriate to the risk of the data collected, to ensure the security of personal data and to prevent their accidental or unlawful destruction, loss, alteration, unauthorized disclosure, or access. The Website has an SSL (Secure Socket Layer) certificate, which ensures that personal data is transmitted securely and confidentially, as the transmission of data between the server and the User, and in feedback, is fully encrypted or coded. However, since Call for Curators cannot guarantee the impregnability of the internet or the total absence of hackers or others who fraudulently access personal data, the Data Controller undertakes to inform the User without undue delay when a personal data security breach is likely to result in a high risk to the rights and freedoms of natural persons. According to Article 4 of the GDPR, a personal data breach means a breach of security leading to the accidental or unlawful destruction, loss, alteration, unauthorized disclosure of, or access to, personal data transmitted, stored, or otherwise processed. Personal data will be treated as confidential by the Data Controller, who undertakes to inform and guarantee through a legal or contractual obligation that such confidentiality is respected by their employees, associates, and any person to whom they make the information accessible.

Rights Arising from the Processing of Personal Data

The User has the following rights recognized in the GDPR and Organic Law 3/2018 of 5 December on Personal Data Protection and guarantee of digital rights:

  • Right of Access: The right of the User to obtain confirmation of whether Call for Curators is processing their personal data and, if so, to obtain information about their specific personal data and the processing Call for Curators has carried out or is carrying out, as well as, among other things, available information about the origin of such data and the recipients of the communications made or planned.
  • Right of Rectification: The right of the User to modify personal data that are inaccurate or incomplete, considering the purposes of the processing.
  • Right to Erasure (“the right to be forgotten”): The right of the User, provided that current legislation does not establish otherwise, to obtain the deletion of their personal data when they are no longer necessary for the purposes for which they were collected or processed; the User has withdrawn their consent to the processing and there is no other legal basis for the processing; the User objects to the processing, and there is no other legitimate reason to continue it; the personal data have been unlawfully processed; the personal data must be deleted to comply with a legal obligation; or the personal data have been obtained as a result of a direct offer of information society services to a minor under 14 years of age. In addition to deleting the data, the Data Controller, considering the technology available and the cost of its application, must take reasonable steps to inform other data controllers processing the personal data of the User’s request for the deletion of any links to those personal data.
  • Right to Restriction of Processing: The right of the User to restrict the processing of their personal data. The User has the right to obtain the restriction of processing when they contest the accuracy of their personal data; the processing is unlawful; the Data Controller no longer needs the personal data, but the User needs them for making claims; and when the User has objected to the processing.
  • Right to Data Portability: In cases where processing is carried out by automated means, the User has the right to receive from the Data Controller their personal data in a structured, commonly used, and machine-readable format and to transmit them to another data controller. Where technically feasible, the Data Controller will directly transmit the data to that other controller.
  • Right to Object: The right of the User to object to the processing of their personal data or to have the processing stopped by Call for Curators.
  • Right not to be Subject to Automated Individual Decision-Making, including Profiling: The right of the User not to be subject to a decision based solely on automated processing, including profiling, except where current legislation provides otherwise.

  • Name and surname of the User. In cases where representation is accepted, it will also be necessary to identify by the same means the person representing the User, as well as the document proving the representation.

  • Any document that proves the request made.

Claims to the Supervisory Authority

In the event that the User considers that there is a problem or infringement of current regulations in the way their personal data is being processed, they will have the right to effective judicial protection and to file a complaint with a supervisory authority, particularly in the State in which they have their habitual residence, place of work, or place of the alleged infringement. In the case of Spain, the supervisory authority is the Spanish Data Protection Agency (https://www.aepd.es/).

II. ACCEPTANCE AND CHANGES TO THIS PRIVACY POLICY

It is necessary that the User has read and agrees with the conditions regarding the protection of personal data contained in this Privacy Policy, as well as accepting the processing of their personal data so that the Data Controller can proceed with it in the manner, during the periods, and for the purposes indicated. The use of the Website will imply acceptance of the Website’s Privacy Policy.

Call for Curators reserves the right to modify its Privacy Policy, according to its own criteria, or due to a legislative, jurisprudential, or doctrinal change by the Spanish Data Protection Agency. Changes or updates to this Privacy Policy will not be explicitly notified to the User. It is recommended that the User consult this page periodically to stay informed of the latest changes or updates.
